By placing a bid for any item, the bidder understands and accepts these terms and conditions:

  • Auction participation by a bidder may be suspended or revoked at the sole discretion of the Asset Forfeiture Program Manager for failure of a bidder to complete a transaction or any other conduct that disrupts the auction process.
  1. All persons are eligible to purchase property forfeited under the provisions of Chapter 712A, HRS, at a public sale except the following employees and their immediate family members:
    • an employee of a county police department;
    • an employee of a county prosecuting attorney’s office;
    • an employee of the state attorney general’s department; or
    • an employee of any other public or private agency that serves as a seizing or petitioning agency or conducts sales of forfeited property
  2. Sales in violation of subsection 1., above, are voidable.
  3. Complaints of violations of subsection 1., above, will be investigated by the Department of the Attorney General or the appropriate state agency and, if found to be valid, appropriate action will be taken to void the sale.
  4. Auction items are "as is." By participating in the auction, bidders accept the current condition of items without warranty.
  5. Each bid is a legal offer to purchase the item subject to auction. Upon the completion of the bidding process, the winning bid constitutes a legal and binding contract to purchase the item. By law, we may pursue legal action to enforce the contract and ask that the court charge you with the court expenses and our attorney fees. Alternatively, if we do not receive your payment within 3 business days or you haven't contacted us to make other arrangements, we may choose to cancel your bid, and either re-auction the item, or offer it to the next highest bidder(s). In such case we have the right to recover the difference between your bid and the final sale price, together with court costs and our attorneys' fees.
  6. Payment must be made online within 3 business days of the close of the auction with a credit card (Visa, Mastercard or American Express). Payment will not be accepted at the pick-up location.
  7. Item(s) must be picked up within 2 weeks of payment. Item(s) may be picked up in person by the winning bidder, his/her representative or a shipping company. If a pick-up is to be made by someone other than the winning bidder, the winner must provide in writing: a) identity of person or shipping company; b) and Item number. Send email to the Asset Forfeiture Program Manager with the subject line "Auction Pick-Up – Item #" (enter your item number after the # sign).
  8. Upon pick-up, the winning bidder or his/her representative must present government issued picture ID and receipt.
  9. Pick-up Location and Hours:
    • Hours: TBA and agreed upon by appointment, between 9:00am to 3:30pm, Monday through Friday. Closed on State of Hawaii and Federal holidays.
    • Items not picked up within fourteen (14) days after payment is made will be dealt with as abandoned property and may be re-auctioned.
    • The bidding process may be subject to regulations established from time to time by the State of Hawaii.
  10. It is strongly recommended that vehicles be properly towed with tow truck or flatbed transporter to their final destination.
  11. Most vehicles have been sitting for an extended period of time and may not be reliable or safe to drive prior to being checked out by a mechanic. Vehicles are titled to the State of Hawaii, and are sold without any license plates affixed to them (State plates may not be used on private vehicles and are destroyed). The registration and safety check is also expired so the vehicle is illegal to operate on public roadways.
